Terms of Sale for Bin Creatives

1. Applicability

These general terms and conditions apply to every offer made by Bin Creatives and to every distance contract concluded between the business and the consumer.
Before the contract is concluded, the text of these terms and conditions will be made available to the consumer.

2. The Offer and Personalization (Custom Work)

Customer Responsibility: The customer is fully responsible for providing the correct customization details (e.g., spelling, grammar, high-resolution images, and layout choices). Bin Creatives will produce the item exactly as submitted and is not responsible for typos or formatting errors made by the customer.
Color and Representation: Due to screen variations and the physical nature of printing on different materials, slight color deviations from the digital preview do not constitute a defect.
Intellectual Property: By submitting a design, image, or text, the consumer guarantees they have the legal right to use it. Bin Creatives is not liable for copyright or trademark infringement resulting from materials uploaded or provided by the customer.

3. Exclusion of the Right of Withdrawal (Important)

No Returns for Custom Items: Because the products sold by Bin Creatives are manufactured according to the consumer's exact specifications and are highly personalized (maatwerk), the standard 14-day European Right of Withdrawal (cooling-off period) does not apply.
Final Sale: Once an order for a personalized item has entered into production, the order cannot be canceled, exchanged, or returned due to a change of mind or buyer's remorse.

4. Production and Delivery

Because items are made to order, standard delivery times may vary. Estimated production and delivery times are clearly stated on the respective product pages.
Bin Creatives strives to meet all delivery deadlines but is not liable for delays caused by third-party shipping carriers.

5. Warranties and Complaints

Defective Goods: The exclusion of the return right applies exclusively to buyer's remorse. If an item arrives damaged, defective, or if Bin Creatives makes a production error (e.g., printing the wrong design), the consumer fully retains their legal warranty rights.
Reporting Issues: The consumer must inspect the delivered goods immediately upon receipt. Any defects or production errors must be reported via email with photographic evidence within 7 days of delivery.
Resolution: If the complaint is justified, Bin Creatives will replace the personalized item free of charge. Refunds are only issued if a replacement is reasonably not possible.

6. Payment

Because products are custom-made and cannot be resold, full payment is required at the time the order is placed, before production begins.

Algemene Voorwaarden voor Bin Creatives

1. Toepasselijkheid

Deze algemene voorwaarden zijn van toepassing op elk aanbod van Bin Creatives en op elke op afstand gesloten overeenkomst tussen de onderneming en de consument.
Voordat de overeenkomst wordt gesloten, wordt de tekst van deze algemene voorwaarden aan de consument beschikbaar gesteld.

2. Het Aanbod en Personalisatie (Maatwerk)

Verantwoordelijkheid van de klant: De klant is volledig verantwoordelijk voor het aanleveren van de juiste personalisatiegegevens (bijv. spelling, grammatica, afbeeldingen met hoge resolutie, lay-outkeuzes). Bin Creatives produceert het artikel exact zoals het is aangeleverd en is niet verantwoordelijk voor typfouten of andere fouten gemaakt door de klant.
Kleur en weergave: Vanwege schermverschillen en de aard van het printen op fysieke materialen, vormen lichte kleurafwijkingen ten opzichte van het digitale voorbeeld geen defect.
Intellectueel Eigendom: Door een ontwerp, afbeelding of tekst in te dienen, garandeert de consument dat hij of zij het recht heeft om dit te gebruiken. Bin Creatives is niet aansprakelijk voor inbreuk op auteursrechten of merkrechten die voortvloeit uit door de klant geüploade materialen.

3. Uitsluiting van het Herroepingsrecht (Belangrijk)

Geen retournering voor maatwerk: Omdat de producten die door Bin Creatives worden verkocht, worden vervaardigd volgens de exacte specificaties van de consument en in hoge mate gepersonaliseerd zijn (maatwerk), is het standaard wettelijke herroepingsrecht van 14 dagen niet van toepassing.
Definitieve verkoop: Zodra een bestelling voor een gepersonaliseerd artikel in productie is gegaan, kan de bestelling niet meer worden geannuleerd, geruild of geretourneerd vanwege een verandering van gedachten (spijtoptie).

4. Productie en Levering

Omdat de artikelen op bestelling worden gemaakt, kunnen de standaard levertijden variëren. De geschatte productie- en levertijden worden duidelijk vermeld op de productpagina.
Bin Creatives streeft ernaar om alle leveringstermijnen te halen, maar is niet aansprakelijk voor vertragingen veroorzaakt door externe vervoerders (zoals PostNL of DHL).

5. Garantie en Klachten

Defecte goederen: De uitsluiting van het retourrecht geldt uitsluitend voor spijt van de aankoop. Als een artikel beschadigd of defect aankomt, of als Bin Creatives een productiefout maakt (bijv. het verkeerde ontwerp afdrukt), behoudt de consument zijn wettelijke garantierechten.
Melden van problemen: De consument dient de geleverde goederen direct na ontvangst te inspecteren. Eventuele gebreken of productiefouten moeten binnen 7 dagen na levering per e-mail worden gemeld, voorzien van fotografisch bewijs.
Oplossing: Indien de klacht gegrond is, zal Bin Creatives het gepersonaliseerde artikel kosteloos vervangen. Restituties worden alleen verleend als vervanging redelijkerwijs niet mogelijk is.

6. Betaling

Omdat de producten op maat worden gemaakt en niet kunnen worden doorverkocht, is volledige vooruitbetaling vereist op het moment dat de bestelling wordt geplaatst, voordat de productie begint.
